The rules that apply when you buy from Home Of Furniture. Plain wording, no traps.

Who you are buying from

Home Of Furniture, trading from 110 S Meadow Ln, Mandan, ND 58554, United States. Placing an order means you accept these terms.

Orders

An order is an offer to buy. The contract starts when we send you a shipping confirmation, not when you click the button. Until then we can decline an order, and we will refund you in full if we do. That would only happen if a piece has sold out, if a price was wrong on the page, or if we cannot verify the payment or the delivery address.

Prices

Prices are in United States dollars and are shown on each product page. Sales tax is added at checkout where we are required to collect it. Shipping is worked out at checkout from the weight and the destination and shown before you pay.

We can change prices at any time, but never after you have placed an order. If a price on the site is obviously wrong, for example a dining table listed at three dollars, we can cancel and refund rather than honour it.

Stock

Stock figures on the site are kept up to date but two people can reach the last piece at the same moment. If that happens we contact you within one working day and offer a wait, a different piece or a full refund.

Descriptions and photographs

We describe every piece as accurately as we can, with real measurements and a real weight. Wood is a natural material, so grain, knots and colour vary from one piece to the next and from the photograph. That variation is not a fault. Screens also show colour differently, so treat the photographs as a good guide rather than an exact match.

Assembly and safe use

Most pieces arrive flat packed with a printed guide. Follow it. Tighten fixings fully and check them again after a few months of use, because wood moves as it settles.

Tall pieces such as bookcases, wardrobes and chests of drawers ship with a wall strap. Fix it to the wall. Furniture that is not strapped can tip, and that is the one risk in the range that actually hurts someone. We are not responsible for injury or damage caused by a piece that was not strapped, was assembled incorrectly, was modified, or was loaded beyond the weight we published.

Delivery and returns

Delivery is covered on the shipping and delivery page and returns are covered on the refund and cancellation page. Both pages form part of these terms.

Our liability

If we get something wrong we will put it right by repairing, replacing or refunding the piece. Beyond that, our liability is limited to what you paid for the order. We are not liable for indirect losses such as lost earnings, the cost of time taken off work for a delivery, or the cost of a decorator who came on the wrong day.

Nothing here removes rights you have under United States consumer law that cannot be removed by agreement.

Using the site

The text, photographs, logo and layout on this site belong to Home Of Furniture or are used with permission. You may not copy them for another business. Do not attempt to break into the site, scrape it in bulk, or interfere with how it runs for other people.

Accounts

If you create an account, keep the password to yourself. You are responsible for what happens under your account. Tell us if you think someone else has got into it and we will lock it.

Events outside our control

We are not responsible for delays caused by things we cannot control, including severe weather, carrier strikes, road closures, power failures and acts of government. If such a delay goes past thirty days you can cancel the affected part of the order for a full refund.

Governing law

These terms are governed by the laws of the State of North Dakota. Any dispute that cannot be settled between us goes to the courts of Morton County, North Dakota.

Changes

We may update these terms. The version that applies to your order is the one published on the day you placed it. Changes are never applied backwards to an order already made.
